Human Image - The Fundamental Legal Fiction

The separation of church and state requires mutually exclusive entities/subjects for mutually exclusive venues and jurisdictions and laws. 
Spiritual and Secular are they. 
In both cases this maxim of law applies: "The Creator has power over his creations".
 
Derativa potestas non potest esse major primitiva. The power which is derived cannot be greater than that from which it is derived.

God created man... and since God created man, man is under God's ultimate control. The word of God is the operative law.

In contradistinction, man created the nations of the world and their associated laws. Hence the kingdoms of man and the laws of man were born. 
Under a nations laws are legal entities (aka Subjects of Kingdoms). Subjects/Citizens are legal entities as are corporations, both being subservient to a nation's or kingdom's authority, and both are capable of suing or being sued. Disputes are judged in accordance to the laws of man. This is the "rule of law".

Of course a man or woman is a creation of God. They are not born a citizen but rather attached to one conceived by the Secular Power. If there were no nations there would be no citizens. A legal name is "conceived" on paper, starting with the registration of birth process and followed up with the certificate of birth. By assuming the legal name one animates the legal entity, thereby falling under the authority of a nations laws. The operative law in this case is known as the "Rule of Law".
 
 HUMAN BEING. From Latin "Humanus": a lesser/inferior man or woman defined legally as an ANIMAL and or MONSTER distinct from the ancient (pre-Vatican) Roman term homo : man. A key rule of law from the 14th century describing a fundamental LEGAL FICTION - that is the NOTION of an inferior man or woman as an animal (as defined by Papal Decree) and therefore not subject to the laws of free men, but the laws of property. The decision to create a second word for Homo (man), denoting an inferior "animal" man was crucial to the legal implementation of the Vatican global slave trade from the 14th century - to overcome the questions of legality and morality of the Vatican slave trade. Therefore, unbaptized indigenous populations were legally defined as "humans" and therefore animals. Legally, the NAME OF A HUMAN MUST ALWAYS BE IN CAPITALS TO IDENTIFY THAT INDIVIDUAL AS PROPERTY as distinct from a free man" Ex-Jesuit Frank O'Collins provided this definition in 2005.

In some nations the law of God and the law of man are both acknowledged.

As such, a legal entity is a fictional entity conceived by the Secular Power.

Legal Fiction
An assumption that something occurred or someone or something exists which, in fact, is not the case, but that is made in the law to enable a court to equitably resolve a matter before it. In order to do justice, the law will permit or create a legal fiction. (http://thefreedictionary.com).


In the case of a "legal person", this is a flesh and blood man (or woman) animating a legal entity in a secular "realm". Subject to all the laws of the realm. This legal person is a persona of civil law.

Man (homo) is a term of nature; person (persona) of civil law. Calvin.

In the jargon of "legalese", legal entities are of "form" ...  not substance.

What is legal is of “form”, what is lawful is of “substance” (Blacks Law 1st Edition).

Form. The antithesis of substance; the appearance or superficial aspect rather than the substance or the essence. (Ballentine's Legal Dictionary 3rd Edition).

Form. 6. The external appearance without the essential qualities.

Human. Of the form and characteristics of man. (From Ballentine's Legal Dictionary 3rd Edition).

In man's law and defined in man's legal dictionaries, a human is not defined as a man .... rather, a human is defined as being merely "of the form of man" - void of the very substance/essence of man.... an image/appearance of man but not man, since the substance of man is missing.

Natural Person: Any human being who as such is a legal entity ….. (Amon v. Moreschi, 296 N.Y. 395, 73 N.E.2d 716." Max Radin, Radin's Law Dictionary (1955), p. 216).

The defined meaning of human is similar to what the bible calls a natural man. 
1 Corinthians 2:14 But the natural man receiveth not the things of the Spirit of God: for they are foolishness unto him: neither can he know them, because they are spiritually discerned

4. The Natural Man:
The "natural man" is the "old man," the "outward man," the "carnal man"-man as he is by nature, as he is firstborn, contra-distinguished to man as he is changed by the Spirit, as he is second-born or regenerated. There. is an "old" life, an "outward" life, a "carnal" life, a "natural" life, as contrasted with the "new" life, the "inward" life, the "spiritual" life, the "gracious" life. The "natural man" is a bold and vivid personification of that depraved nature which we inherit from Adam fallen, the source and seat of all actual and personal transgressions.



As defined above, the antithesis of "form" is substance. Substance (aka essence) is in dispute with and/or in opposition to "form". Substance is in controversy with "form" by definition.
SUBSTANCE, evidence. That which is essential; it is used in opposition to form. (Bouvier's Law Dictionary).

 

Websters Dictionary 1828 ....

Substance. 1. In a general sense, being; SOMETHING EXISTING BY ITSELF; THAT WHICH REALLY IS OR EXISTS; EQUALLY APPLICABLE TO MATTEROR SPIRIT. Thus the SOUL OF MAN IS CALLED AN IMMATERIAL SUBSTANCE, a cogitative substance, a substance endued with thought.


SPIRITUAL,  a.1. Consisting of spirit; not material; incorporeal; as a spiritual substance or being. The soul of man is spiritual.(KJV Dictionary Definition) 

. Spiritual. Pertaining to the soul rather than the physical body of man. The higher as distinguished from the material or carnal nature of man...... it has been held to mean that which pertains to the soul or higher endowments of the mind in its relation to the Spirit of God, the Holy Spirit, and that which pertains to our holy religion. The spiritual nature of man would be his higher self, not the carnal. Johnson vs State, 107 Miss 196, 65 So 218. (From Ballentine's Legal Dictionary 3rd Edition).


SPIRIT. 1.: an animating or vital principle held to give life to physical organisms (Miriam Webster Dictionary).

James 2-26. For as the body without the spirit is dead, so faith without works is dead also.

Genesis 2-7. And the LORD God formed man of the dust of the ground, and breathed into his nostrils the breath of life; and man became a living soul.


Lets put this all together: 
Man's substance/essence is the material and immaterial (spirit). 
Form is the antithesis of substance/essence (fiction).
So, one acting "without" the principal "substance/essence" is NOT acting in the capacity of a man, instead, he/she is acting in the lesser capacity of a human (a false image), one  of  the "form" and characteristics "ONLY".  
He/she is acting in opposition to the substance/essence of man. 
This is a secular capacity for the secular and temporal world.


What precisely is in opposition to (the antithesis of) the substance of man? This is a fiction, a false image of man.

 JUDICIAL IDOL WORSHIP

Who would be the father of idol worship, of paying reverence to the outward form and ignoring the indwelling spirit?
Father. The originator and transmitter of anything; the author of a family or society of persons animated by the same spirit as himself; one who has infused his own spirit into others, who actuates and governs their minds. (Thayers Greek Lexicon).

Below is more information regarding the character of the human being. As you will see below, this character looks rather like an entity of the anti-christ.

Humanitarian. 
a philanthropist; an anti-Trinitarian who rejects the doctrine of Christ's divinity; a perfectionist.

Secular Humanism. Human thoughts are thoughts that belong to man or are relative to man. They are thoughts of man.
A human being is a being that belongs to man or relative to man. A being of man, not a being of God. This being is mundane, secular and opposed to the divine. The antithesis of the Holy Spirit - in controversy with the Holy Spirit.

Naturalism. A system of morality or religion having a purely natural basis; a view of the world, and of man's relationship to it, in which only the operation of natural, as opposed to supernatural or spiritual, laws and forces is assumed.' and 'naturalist' is defined as: 'One who follows the light of nature, as contrasted with revelation. Of course the dark forces of this world would like to do away with the indwelling spirit altogether. The link below clearly shows the son of perdition hard at work.

Romans 1:25 Who changed the truth of God into a lie, and worshipped and served the creature more  than the Creator, who is blessed for ever. Amen.

Deleuze can be said to reply with the following: “God made man in his image and resemblance. Through sin, however, man lost the resemblance while maintaining the image. We have become simulacra. We have forsaken moral existence in order to enter into aesthetic existence” (Deleuze, 1990).


 



In legalese, a human being may also be referred to as the "color of man". An entity suitable for the color of law. 

Another way to express this: A Human Being is a simulacrum of man. 

Color. An appearance, semblance, or simulacrum, as distinguished from that which is real. A prima facie or apparent right. Hence a deceptive appearance ; a plausible, assumed exterior, concealing a lack of reality ; a guise or pretext. . . . Black's Law 4th Ed.
Assume. To pretend. To undertake: engage; promise... Also taking up, receiving, adopting, taking to oneself, or to put on deceitfully, take appearance of, affect, or outwardly seem... to take on, become bound as another is bound, or put oneself in place of another as to an obligation or liability.... Black's Law 4th Ed.


SIMULACRUM. 2. Something having the form but not the substance of a material object. ( Websters' 3rd New International Dictionary pg. 2122)


SIMULACRUM. (plural: simulacra from Latin: simulacrum, which means "likeness, similarity"), is a representation or imitation of a person or thing.[1] The word was first recorded in the English language in the late 16th century, used to describe a representation, such as a statue or a painting, especially of a god. By the late 19th century, it had gathered a secondary association of inferiority: an image without the substance or qualities of the original.

The formation of the "human being" fulfills the requirement for a secular " subject " for a secular society and subject to secular laws (the Rule of Law). Just as man has a Father (the Creator), Legal Entities have a Father as well. 

Just for giggles...

Lets dissect the compound word hu-man to see what we get !
Human ;  IE Hue man.
We see that HUE is defined as COLOR which is defined as SIMULACRUM.

So, by investigating the compound word human we also arrive at the same conclusion as the legal definition. Since a human lacks the principle aspect of man, a human cannot be defined as "man". A human is merely defined as the "form of man", which is equivalent to the appearance of man, rather than the substance or essence of man. The act of believing a human is equivalent to man is a delusion.

Does coming out of Babylon have anything to do with this legal entity and or human, which are of mere form and the antithesis of the Holy spirit? 

Since the very onset in life we are associated with a legal entity created through the registration of birth process, which is a "legal" government document. Almost everyone accepts this legal entity as who they are, albeit not knowing the true nature of this secular entity.

Does this legal entity have anything to do with being born in slavery and sin? ....  obligated to the laws of man (righteous or not)?

Is the legal entity our personal "beast" of burden (taxpayer)?

Would we be able to labour for wages and therefore buy and sell without legal identification and a "SIN" (social insurance number).


To exit Babylon, will we need to abandon the worldly legal entity that we are born with? Will we then be released from the laws of man and be only beholden to the righteous laws of God? Will we then be a new creature under God and God alone?
